Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Klariti application, website, and related services (collectively, the "Platform"), operated by Klarititec Technologies Private Limited ("Klariti," "we," "us," or "our"), a company incorporated under the laws of India.

By creating an account, accessing, or using the Platform, you ("User," "you") agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. About Klariti

Klariti is a health-technology platform that primarily helps users understand their medical reports, decode their health insurance coverage, and store health documents safely. Klariti is currently in an early-access phase, and features, availability, and functionality may change without prior notice. 

2. Eligibility

  • You must be at least 18 years old to create an account and use the Platform in your own name.

  • You may create profiles for family members (including minors) under your care, provided you are their parent, legal guardian, or otherwise authorized to manage their health and insurance information. You are responsible for ensuring you have the right to submit another person's data to the Platform.

  • By using the Platform, you represent that all information you provide is accurate and that you have the authority to provide it.

3. Description of Services

The Platform currently offers:

3.1 Medical Document Intelligence

Upload of medical reports, prescriptions, scans, and discharge summaries for AI-assisted, plain-language interpretation, including condition summaries, severity indicators, and suggested next steps.

3.2 Insurance Navigation

Upload of insurance policy documents for AI-assisted decoding of coverage terms, exclusions, waiting periods, and related information, framed in plain language.

3.3 Secure Storage

Storage of health and insurance related information for easy access. 

3.4 Family / Multi-Profile Management

Tools to manage health and insurance records for multiple family members under a single account, subject to each adult member's independent consent under applicable data protection law.

Klariti may add, modify, suspend, or discontinue any feature at any time, particularly during the early-access phase.

4. Not Medical or Financial Advice

4.1 Medical Disclaimer

Klariti explains your reports to help you have better conversations with your doctor. This is not a medical diagnosis. All AI-generated summaries and interpretations are informational only and must not be relied upon as a substitute for consultation with a qualified, licensed healthcare professional. Always seek the advice of a physician or other qualified health provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on the Platform.

4.2 Insurance Disclaimer

Any insurance-related content on the Platform is limited to translating policy language into plain English. It does not constitute insurance advice, a coverage assessment, a claims recommendation, or a guarantee of coverage or reimbursement. Actual coverage, eligibility, and claim outcomes are determined solely by your insurer in accordance with your policy terms. Where Klariti facilitates access to a licensed insurance intermediary (such as a partner broker), that intermediary's advice is provided independently and under its own regulatory license — not by Klariti.

4.3 Emergencies

The Platform is not designed or intended for use in medical emergencies. If you believe you are experiencing a medical emergency, contact your local emergency services or go to the nearest hospital immediately. Klariti does not use, and does not intend for any output to be interpreted as, an emergency or urgent-care triage signal.

5. User Accounts

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

  • You must notify us promptly of any unauthorized use of your account.

  • We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

6. Your Data and Privacy

Your use of the Platform is also governed by our Privacy Policy which describes how we collect, use, store, and protect your personal and health data, and how we comply with the Digital Personal Data Protection Act, 2023 (DPDP Act) as a data fiduciary.

Key points:

  • We collect data only for the specific purposes you consent to, and you may withdraw consent at any time.

  • You may request deletion of your data, including uploaded documents and derived health insights, subject to legal retention requirements (e.g., audit logs for regulatory purposes).

  • Medical and insurance data are treated as sensitive personal data and are handled with heightened security controls.

  • We do not sell your personal or health data to third parties.

By using the Platform, you consent to the processing of your data as described in the Privacy Policy.

7. User Responsibilities

You agree to:

  • Provide accurate, current, and complete information;

  • Use the Platform only for lawful, personal, non-commercial purposes;

  • Not upload documents or information that you do not have the legal right to submit;

  • Not attempt to reverse-engineer, scrape, or misuse the Platform or its AI systems;

  • Not impersonate any person or misrepresent your relationship to any family member profile you create.

We reserve the right to suspend or terminate access for any use that violates these Terms, is fraudulent, or poses a risk to the Platform, other users, or third parties.

8. Subscription and Payments

Klariti currently offers certain features free of charge. We may introduce paid premium features, subscription plans, or one-time purchases in the future ("Paid Services"). Where Paid Services are introduced:

  • Pricing, billing frequency, and included features will be clearly disclosed before purchase;

  • Payments will be processed through third-party payment providers; Klariti does not store your full payment card details;

  • Refund and cancellation terms will be specified at the time such services are introduced and will be incorporated into these Terms by reference;

  • Continued use of free features will not be affected by the introduction of Paid Services unless explicitly communicated.

9. Content Ownership and License

9.1 Klariti's Platform IP

All content, branding, software, design, and technology underlying the Platform (excluding your own uploaded documents and data) are the exclusive property of Klarititec Technologies Private Limited or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

9.2 Your Content

You retain full ownership of the medical reports, policy documents, and other data you upload ("User Content"). Klariti does not claim ownership over your User Content.

9.3 License You Grant to Us

By uploading User Content, you grant Klariti a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to store, process, and analyze that content solely to (a) provide you the Services, (b) maintain backups, and (c) improve the product in a de-identified or aggregated form where permitted under the Privacy Policy and applicable consent. This license ends when you delete the relevant content or your account, subject to legally required retention (e.g., audit logs).

9.4 Access Control

Your uploaded documents and derived summaries are private to your account by default and are not accessible to other users unless you explicitly share them (e.g., with a family member profile you manage).

9.5 Content Moderation

Klariti does not actively screen User Content before processing, but reserves the right to reject, remove, or restrict access to any content or account that is unlawful, fraudulent, or violates these Terms, our Privacy Policy, or the rights of others.

10. Limitation on Use

The Platform is intended for personal, non-commercial use only. You agree not to:

  • Reverse-engineer, decompile, or attempt to extract the source code or underlying AI models of the Platform;

  • Rent, lease, sell, sublicense, or otherwise commercially exploit the Platform or its output;

  • Use bots, scrapers, crawlers, or other automated means to access, monitor, or duplicate any part of the Platform without our prior written consent;

  • Probe, scan, or attempt to identify other users, their data, or the Platform's architecture and security;

  • Use the Platform or its output to build a competing product or service.

Violation of this section may result in immediate suspension or termination of your account without notice.

11. Third-Party Services and Links

The Platform may link to, integrate with, or facilitate access to third-party services (e.g., clinics, labs, insurance related intermediaries, hospitals, payment processors). Klariti is not responsible for the content, accuracy, or practices of third parties, and your use of such services is governed by their own terms and privacy policies.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose.

  • Klariti does not guarantee that AI-generated interpretations of medical or insurance documents will be complete, accurate, or error-free.

  • Klariti shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of health, financial loss, or loss of data, arising from your use of or reliance on the Platform.

  • Klariti's total aggregate liability arising out of or related to these Terms or the Platform shall not exceed the amount, if any, paid by you to Klariti in the twelve (12) months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable Indian law, including in respect of gross negligence or willful misconduct.

13. Indemnification

You agree to defend, indemnify, and hold harmless Klarititec Technologies Private Limited, its officers, directors, employees, and partners from any claims, damages, obligations, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of, or access to, the Platform and its Services;

  • Your breach of any provision of these Terms;

  • Your infringement of any third-party right, including copyright, property, or privacy rights;

  • Any claim that your User Content caused harm to a third party;

  • Your submission of another person's medical or personal data without proper authorization.

14. Right to Modify, Suspend, or Terminate

14.1 Service-Level Changes

Klariti may modify, suspend, or discontinue the Platform, in whole or in part, temporarily or permanently, at any time, with or without notice — particularly given the current beta status of the product.

14.2 Account-Level Termination

You may stop using the Platform and request account deletion at any time. We may suspend or terminate your account, with or without notice, if you violate these Terms, misuse the Platform, or if required by law. Termination may result in deactivation or removal of your account and associated content, subject to the data retention and deletion terms in the Privacy Policy.

15. Changes to These Terms

We may update, amend, or supplement these Terms from time to time to reflect changes in our services, legal requirements, or business practices, at our discretion. Material changes will be communicated via the app, website, or email where feasible, along with an updated "Last Updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

16. Miscellaneous

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Klariti regarding the Platform.

  • No Waiver: Our failure to enforce any right or provision will not be considered a waiver of that right.

  • Assignment: You may not assign your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Subject to any mandatory consumer protection provisions, the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or your use of the Platform.
